DEEDS OF RELEASE ALERT : Recently our office has been receiving a number of phone calls from employees regarding their employment circumstances regarding their unpaid wages claims, long service leave claims, redundancy rights and workplace bulling claims post their Fair Work Australia unfair dismissal conference. Generally we have been unable to assist them because they have signed a Deed of Release curtailing all their contractual and employment rights (with the exception of statutory workers compensation) at the time of their unfair dismissal conference. May you please be very careful when signing the deeds of release and preferably consult a solicitor with extensive workplace relations and personal injury knowledge regarding your contractual, employment and industrial rights.
WORKPLACE BULLYING NEWS ALERT : Recently we have been receiving numerous calls regarding workplace bullying and it seems the problem is rampant in various organisations. Workplace bullying may refer to an employee being unfairly treated, ridiculed infront of other employees, being provided selective help and or undue / unfounded workplace criticism. Over the last three years there have been substantial judgments for workplace (Naidi v Group 4 Securitas) (Bailey and Peakhurst Bowling Club) and recently Sneddon and the Speaker of the Legislative Assembly. OWNER DRIVER TERMINATION NEWS ALERT : Over the last 6 months there has been a steady increase in the termination of owner driver. Owner drivers are individuals who own their own truck and are paid to transport goods and materials. Throughout Australia, various jurisdictions e.g NSW (Industrial Relations Act), VIC : Owner Drivers and Forestry Contractors Act ) , WA (Owner Drivers (Contracts and Disputes Act) have mechanisms to assist owner drivers.
